Job Description

SUMMARY

Acts with a high degree of autonomy and authority to provide legal counsel to the full panoply of employment and labor issues.  Provides guidance to leadership on US and Canadian federal, state and local employment laws.  Stays abreast of legislative, regulatory and judicial developments ensuring the company remains compliant.  Works with H.R. and leadership to proactively identify and mitigate potential liability.  Provides legal support to benefits department on benefits design and compliance matters.  Reviews significant employment actions and agreements as needed.  Oversees legal compliance in the employment area and works as a member of the company’s Ethics Committee, including investigating and responding to ethics hotline issues. Provides strategic advice and counsel in support of union organizing, collective bargaining, contract interpretation/administration, NLRB matters, work stoppages, labor litigation and grievances.  Responds to administrative charges/complaints/investigations and represents the company in hearings and labor arbitrations.  Sets the strategy and manages all types of employment litigation. 

DUTIES AND RESPONSIBILITIES

May include, but are not limited to, the following:

  • Provides expertise and advice on a variety of issues including, but not limited to:  workers’ compensation, termination of employment, sexual harassment, workplace safety, wage and overtime standards, privacy rights, ERISA, discrimination, and employee benefits. 
  • Advises on contracts, policies and procedures and advises leadership on proposed changes. 
  • Recommends legal action, mediates disputes between employees and employers, and represents clients in court in civil lawsuits against employers.
  • Participates in union negotiations and handles matters which involve collective bargaining. 
  • Responds to administrative charges/complaints/investigations before federal and state agencies and represents the company in administrative hearings and labor arbitrations.
  • Provides strategy for conducting union avoidance efforts and responses to union organizing efforts.

EDUCATION, EXPERIENCE AND QUALIFICATIONS

  • Juris Doctorate degree and licensed, as a member in good standing, to practice law in Texas, or otherwise eligible to practice as an in-house corporate attorney.
  • Strong academic credentials from a top-rated accredited law school.
  • Minimum of 10 years of experience, preferably with major law firm and in-house corporate experience.
  • Strong writing and verbal skills.
  • Strong business acumen with an ability to balance legal and business requirements.
